User Generated Content Terms & Conditions

Overview: Visit Hershey & Harrisburg (VHH) is a non-profit destination marketing organization. Our content sharing program helps us share our destination’s story by sharing YOUR photos and videos from your experiences here. We’re happy to highlight your content and give you credit on our social platforms, website galleries, and/or e-newsletters. The following Terms & Conditions apply to Visit Hershey & Harrisburg’s User Generated Content (UGC) applications.

User Generated Content Sharing Terms & Conditions
(#yesVHH and Public Uploader Tool)

Notice: Visit Hershey Harrisburg may occasionally sponsor photo contests. Photo contest rules are governed by their own Terms & Conditions that are separate from these Terms & Conditions.

1. License

By sharing your content with us, you grant to Visit Hershey & Harrisburg and its Sites, as defined below (“collectively VHH”), a license to use your Content, defined as any image, video, audio, graphics, and/or text you provide to us.  You may not change or adjust any of these Terms & Conditions unless expressly agreed to in writing by an authorized representative of VHH.  Please read these Terms & Conditions carefully.

2. VHH Sites

These Terms & Conditions apply to VHH and its current and future “Sites” and associated social media platforms under our control. Collectively, “Sites” currently include Explore HBG (ExploreHBG.com), Hershey Harrisburg Sports & Events Authority (HHSportsandEvents.com), but also include any other Sites promoting Dauphin County as a destination for vacation travel, meetings, sports, and special events.

3. Permission to Share

You grant VHH the right to share Content by:

  1. Replying “#yesVHH” to a VHH share request on a social platform and/or
  2. Uploading content via the Uploader tool embedded on VisitHersheyHarrisburg.org

4. Allowable Participants

You must be at least 18 years of age or older and have the legal rights in and to the Content to grant us a license to use your Content.

5. Ownership of Content

You warrant that all Content shall be appropriate for public sharing, free and clear of any claim, right or encumbrance that would limit or restrict the license granted to VHH and that the use of the Content by VHH shall not violate any copyright, trademark, moral right, right of privacy or right of publicity, or infringe or misappropriate any intellectual property rights of any third party. You represent and warrant that you have all the necessary rights, title, and interest required to grant a license to VHH. For any social audio, you represent and warrant that you have followed applicable platform’s guidelines for uploads containing music.
6. Permission of Subjects

You represent and warrant that you have obtained explicit permission to share from all identifiable individuals who appear in any Content, including consent from a parent and/or guardian of subjects under 18 years of age and that these subjects understand that no payment or compensation of any kind will be made by VHH to any subject appearing in such Content.

7. Voluntary Assignment of Rights

You represent and warrant that you are voluntarily providing VHH with a license to use your Content and will not receive any compensation or payment of any kind.

8. Rights to Use Content

You hereby grant to VHH a perpetual, worldwide, royalty-free license to use, access, load, download, store, copy, publish, distribute, communicate, exhibit, produce, display the Content for destination marketing purposes, including on such things as current and future social platforms, website galleries, or e-newsletter communications with credit to you. VHH is under no obligation to use the Content.  Except for VHH license pursuant to these Terms & Conditions, you will own all rights in and to the Content. To the extent your Content contains other materials or elements owned by VHH or any third-party licensors, such as characters or other elements protected by copyright, trademark or other laws, your rights to make use of the Content will continue to be governed by and may be limited by other applicable laws, the rights of third parties and VHH.

9. Credit for Content

VHH shall exercise all reasonable efforts to correctly include credit to you when using the Content, provided that the details such as your name and/or social media identity (handle) are included by you. Credit may be achieved in one or more of the following ways based on supplied information: 1) direct digital link to the original content 2) tagging the user’s supplied social username 3) adding the user’s submitted name if no username is identified.

10. Non-Confidentiality

You understand and agree that by replying to a share request with #yesVHH or by utilizing the Uploader tool, the Name/User Name and Content you share may be publicly displayed on the Sites, including social, website, and e-newsletter platforms.

11. Content Removal Requests

Requests for Content to be removed from VHH Sites and/or social platforms should be sent to:  ask@hersheyharrisburg.org.  VHH will address the request within thirty (30) days of acknowledging receipt of the request for removal.

12. Indemnification

You agree to indemnify, defend, and hold harmless VHH and its agents, directors, officers, affiliated entities, employees, contractors, and third-party providers (“Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, expenses or fees (including reasonable attorney’s fees) that any of the Indemnified Parties may incur arising out of or related to your Content, or your breach of these Terms & Conditions.

13. Modifications

VHH may, in its sole discretion, change these Terms & Conditions at any time. Any changes will be posted on VisitHersheyHarrisburg.org and will be effective upon posting unless another effective date is specified.
